1- Customer Acknowledgement
The Customer acknowledges agreement with these Terms and Conditions of Sale by the placement of an order to purchase product from WRLS Trust trading as (Lima Zulu, Team Lima Zulu, Lima Zulu Australia).
Lima Zulu is a trading name of WRLS Trust This contract of sale is between the entity named on the invoice (the "Customer") and WRLS Trust ("Lima Zulu Pty Ltd").
All goods are supplied on these terms and conditions only and no person in the employment or otherwise as agent for Lima Zulu has any authority to supply goods on any other terms and conditions or to vary these terms and conditions in any way whatsoever. Previous dealings shall not vary or negate these terms and conditions in any respect.
Limazulu.com.au, (the “Site”) is an online shopping website where you can browse, select and order products from WRLS Trust trading as Lima Zulu Pty Ltd ACN: 142432657.
Access to and use of the Site, including your order of Products through the Site, is governed by these terms and conditions.
2 - Compliance
You agree to comply with, these terms and conditions.
You agree to comply with all relevant laws relating to your use of the Site and your placement of any order through the Site.
3 - Placing an order for Products
You may order Products by submitting your order through the Site in accordance with these terms and conditions.
Order placed through this Site is an offer by you to purchase the Product for the price notified (including the delivery and other charges and taxes) at the time you place the order.
Additional details may be required to confirm your details and enable us to process any orders placed through the Site.
You agree to provide us with current, complete and accurate details when asked to do so by the Site.
4 - Acceptance or rejection of an order
Under certain circumstances, we may need to reject your order. This may happen where your details cannot be confirmed, the requested Product is not available or if there is an error in the price or the product description posted on the Site.
Orders placed for Products through the Site that we accept results in a separate binding agreement between you and us for the supply of those Products. For each order accepted by us, we will:
(a) Supply the Products in that order to you in accordance with these terms and conditions and
(b) provide you with an email confirmation of that order.
If an order is rejected through the Site, then we will endeavour to notify you via email of that rejection at the time you place the order or within 2 days after you submit your order.
5 - Restricted Products
If you are:
Under 15 years of age, then you may not use the Site to order a Product that is classified MA 15+ or a Restricted Game unless:
(i) You have the consent of your parent or guardian; and
(ii) You live in and the Delivery Address for the order is in:
6 - Delivery of Products
We will only deliver Products ordered through the Site to a location where we provide delivery services.
You may obtain further information on the Site about our delivery timeframes and how we deliver certain Products. You can find out more by visiting our Delivery information page.
The Delivery Fee for your order depends on the type of Product you order (in particular, the size and weight of the Product).
You agree to comply with certain delivery requirements specified below and other requirements that we notify you when you place your order through the Site.
Lima Zulu also recommends that you be present to accept the delivery of your order if you have paid by credit card.
We may require the person accepting the delivery of your order to:
(a) provide us with proof of that person’s identity. If the order has been paid by credit card, then we may also ask you to show us the credit card for us to conduct our verification checks and
(b) Provide us with proof that the consents referred to under the “Restricted Products” section of these terms and conditions have been obtained.
Should the address be unattended goods will be taken back to a local Australia post office and a card left for you to arrange pickup from the Australia Post Office
You:
(a) Agree that any person at the Delivery Address who receives the Products is authorised by you to receive your order and
(b) Will ensure that the person receiving any Restricted Film or Restricted Game or other relevant Restricted Products is over the required age as prescribed by law and, in the circumstances referred to in these terms and conditions, you are, or accompanied by a person that is over the age of 18 years.
7 - Risk and title
Risk and title to the Products passes to you on the date and time of delivery to the Delivery Address.
8 - Cancelling an order
We may cancel any part of an order without any liability to you for that cancellation at any time if:
(a) the Products in that order are not available; or
(b) there is an error in the price or the product description posted on the Site for the Product in that order or
(c) that we reasonably believe your order has been placed in breach of these terms and conditions.
If we do so, then we will provide you with reasonable notice of that cancellation, and will not charge you for the order.
You may cancel an order by contacting us through the contact us form or emailing us customerservice@limazulu.com.au quoting your order number at any time prior to the dispatch of that order. Once the order has been dispatched for delivery to you
9 - Fees and charges
We will charge you, and you agree to pay, the purchase price of each Product that is ordered, the delivery fee for your order that we notify to you when you place your order.
All fees and charges identified in these terms and conditions and all prices for the Products include GST where applicable.
The purchase price of each Product is shown on the product list on the Site at the time you place your order.
Prices for Products change from time to time and we do not provide any notice of these changes. Subject to these terms and conditions, once we have accepted your order, we will not change any prices that apply to the Products in that order.
If you cancel an order and the cancellation is accepted:
We will refund any amounts paid by you for that cancelled order, We will not refund the Delivery Fees where the Products in your cancelled order have been dispatched for delivery.
10 - Payment methods
You may pay the fees and charges for an accepted order using the following payment methods:
- Visa
- MasterCard
- Direct deposit as set out below.
If we are unable to successfully process your credit card payment for your order that is accepted by us, then we retain the right to cancel your order.
If you have chosen to use direct deposit to pay for your order, the details of our account details will be provided in our checkout process regarding where and how the fees and charges need to be deposited.
Once you have deposited the amount for the fees and charges for your order, then you will then need to contact Customer Service to complete the payment process. If you wish to use this payment method, you must allow at least 48 hours for confirmation of your payment. If you do not deposit the relevant amount for your order into our nominated account within 5 business days of the date of the order, then we will contact you.
If you choose to pay by credit card, you authorise us to debit the amount that is payable for an accepted order from your nominated credit card.
You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.
We will provide you with a receipt at time of delivery which specifies the total fees and charges for the Products in the order.
11 - Damaged Products and returns
You must check any Product delivered to you to determine if it is damaged. If a Product is damaged on delivery, then you should contact us immediately through our Contact Us form.

12 - Termination
We may immediately suspend, terminate or limit your access to and use of the Site and your account if you breach these terms and conditions and
The breach cannot be remedied, You fail to the remedy the breach within 7 days of our notice to you of that reach, if there is an emergency.
13 - Changes to these terms and conditions
These terms are subject to change and may be different and so we recommend that you read these terms carefully each time you agree to them during the ordering process.
We will not change any terms and conditions for an existing order that has been accepted by us, the terms and conditions that will apply to the order.
14 - Privacy policy
We respect your privacy. We collect, hold, use and disclose your personal information in accordance with the Privacy Act 1988. The manner in which we generally collect, hold, use and disclose your personal information is set out in our Privacy Policy below.
We will collect your personal information through your use of the Site or through your personal contact with us. You agree for us to collect, hold, use and disclose your personal information in ways we consider appropriate.

15 - Security
Lima Zulu uses a secure server and is SSL 128-bit encrypted to make sure your details are safe when completing a transaction.
16 - General
This agreement is governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.
17 - Ownership; your use of the website
The Website (including all content, graphics, and other intellectual property and elements incorporated into the Website) is the property of Lima Zulu and/or others, and is protected by Australian and international copyright, trademark and other laws. Your use of the Website does not transfer to you any ownership or other rights in the Website or its content.
The Website may not be used for unlawful or commercial purposes; it is for your lawful, personal use only. You may use the Website only as expressly permitted in these Terms and subject to all applicable laws. The Website and its content may not be copied, reproduced, modified or distributed in any way without the express prior written consent of Lima Zulu. You may not sell or resell any part of the Website or access to the Website. You may not use any of the software that is used in the operation or provision of the Website except while you are using the Website in accordance with these Terms.
You may use the Website only if you are a resident of Australia, have reached the age of 15 and you can form legally binding contracts under applicable law. Lima Zulu may request proof of identification and age (for example, proof of your ability to purchase certain games). We ship products only to addresses in Australia.
18 - Errors and product availability; offers to purchase
Errors, misprints and omissions (including incorrect prices, descriptions or specifications for products) may sometimes occur. Lima Zulu does not guarantee that products and services advertised on our Website will be available when ordered or thereafter. Lima Zulu makes no warranty that the content of the Website, including product descriptions or photographs, is accurate or complete.
Lima Zulu may at any time, without any prior notice or liability to any Website user (a) correct any error, inaccuracy or omission; (b) change the products and services available on the Website, or the prices, fees, and specifications of such products and services, or any promotional offers and any other Website content; (c) reject, correct, cancel or terminate any order, including accepted orders, for any reason and (d) limit quantities available for sale.
The advertisements on the Website are invitations to you to make offers to purchase products and services on the Website and are not offers to sell. All prices and other amounts appearing on the Website are quoted in Australian dollars.
If we make an error in the description of a product or offer on our website, we may correct or remove the product or offer description at any time. In the event that a product or offer is mispriced or made in error, we reserve the right to refuse the offering and withdraw any advertising relating to the offer or product. Any products or offers that are advertised on our website are strictly for offer on our website and will only be honoured within our stores at our discretion.

Lima Zulu™, the limazulu.com.au logo and other names and logos that are used on our Website (the "Marks") are registered or unregistered trademarks, service marks, trade names and logos owned or licensed by Lima Zulu or their respective owners or licensees. Any use of the Marks (other than as permitted by these Terms) is prohibited. Nothing in this Website shall grant, or is intended to grant, any license or right to use any of the Marks.
20 - No linking, framing, mirroring, scraping, data-mining or unauthorized postings
Linking to the Website without the prior written permission of Lima Zulu is prohibited. If you desire to link to our Website, you may send an email to web@limazulu.com.au
requesting such permission. Lima Zulu may in its discretion deny or revoke any permission it may give to link to the Website at any time and without any notice or liability.
The framing, mirroring, scraping or data-mining of the Website or any of its content in any form and by any means is prohibited. You may not use any collaborative browsing or display technologies in connection with your use of the Website or to post comments or any other information of any kind to or on the Website that would be visible to any other users, except in connection with the use of Lima Zulu forums or other Website locations intended for such comments and hosted by Lima Zulu.
21 -Contests
Lima Zulu may make contests available to users of the Website and others. All contests are governed by these Terms and the applicable contest rules. By participating in a contest through the Website, you are agreeing to these Terms and the applicable contest rules.
Purchasing by children under 15 years old and minors
For the protection of our shoppers, it is our policy to not sell to children under 15 years of age. If you are a minor, and wish to purchase from our online store, please have a parent or legal guardian make the purchase for you.
Errors and misprints
If we make an error, we may correct or cancel an order at any time, and/or edit an order to reflect the correction (you will have the right to approve or confirm any increase in price or shipping charges), and/or correct the error on our Website. In the event that you are shipped an incorrect product, we will accept the return of the unit and provide you with a refund.
If we discover that a product’s description or specifications are misstated or incorrect, we will endeavor to correct the error.
Advertising rebate policy
Any applicable taxes are calculated and payable on the price before applying the rebate. Postage must be paid on mail-in rebates. Lima Zulu is not responsible for manufacturer mail-in rebates.
Delivery
Delivery is subject to warehouse availability. Back-Order items will be shipped as soon as possible, upon arrival from the manufacturer/publisher. Please take shipping time into consideration.

Definitions
Capitalised terms used are defined in these terms and conditions. In these terms:
Classification Board means the Classification Board established under the Classification (Publications, Films and Computer Games) Act 1995 (Cwlth).
Contact Hours means. 9am to 5pm Monday to Friday (Sydney time).
Delivery Address means the address specified by you during the customer registration process for the delivery of Products that we will supply to you under these terms and conditions.
GST has the meaning it has in the A New Tax System (Goods and Services Tax) Act 1999 (Cwlth).
LoginID means the email address that you provided to us as part of the registration process to use the Site.
MA 15+ means the MA 15+ classification in the Classification (Publications, Films and Computer Games) Act 1995 (Cwlth).
R 18+ means the R 18+ classification in the Classification (Publications, Films and Computer Games) Act 1995 (Cwlth).
Product means each good or service that is advertised on the Site.
Restricted Film means a film that has been classified MA 15+ or R 18+ by the Classification Board.
Restricted Game means a computer game that has been classified MA 15+ by the Classification Board.
Restricted Product means a Product that is subject to certain restrictions (for example, age restrictions) on its sale by a relevant law, such as a Restricted Film or a Restricted Game
